BIE Notice of Public Comment on COVID-19

The U.S. Department of Education (US ED) is providing States, including the Bureau of Indian Education (BIE) with program flexibilities to meet the needs of students and educators during the ongoing COVID-19 pandemic and the unprecedented challenges students, educators, staff, and schools faced during the 2020-2021 school year. The US ED is offering each state educational agency SEA, including the BIE, the opportunity to request waivers that will afford additional fiscal flexibility for certain funds received under the Elementary and Secondary Education Act of 1965 (ESEA). The US ED recognizes it may not be possible to obligate these funds on a timely and responsible basis due to several factors.

In response, the BIE is offering a waiver for an LEA/school to be able to approve a local educational agency (LEA)/school to carry over more than 15-percent of its fiscal year FY 2020 (SY2019-2020) Title I, Part A funds (i.e., the Title I, Part A funds that will become carryover funds on October 1, 2021), even if the LEA/school has received a waiver from its BIE to exceed this limitation for its FY 2018 or FY 2019 Title I, Part A funds. This would be the SY 2018-2019 and 2019-2020 ESEA allocations a school received. Second, the BIE is offering flexibility to each LEA/school to be able to extend the period of availability of FY 2019 funds for programs included in the BIE’s consolidated application plan to allow additional time to obligate those funds. These would be allocations the school received in SY 2019-2020.

Pursuant to the authority under section 8401 of the ESEA, BIE is requesting waivers of the following provisions:

Section 1127(b) of Title I, Part A of the ESEA so that your school may waive, more than once every three years, if necessary, the 15-percent carryover limitation in ESEA section1127(a) for FY 2020 Title I, Part A funds.

Section 421(b) of the General Education Provisions Act (GEPA) to extend the period of availability of FY 2019 (SY 2019-2020) funds for programs in which your SEA participates under its approved BIE consolidated application plan until September 30, 2022.

BIE is providing BIE-funded schools, educational partners, and stakeholders with this public notice and an opportunity to comment on this waiver.

FFY 2021 IDEA Part B Grant Award Application - Public Comment

Under the General Education Provisions Act and the Individuals with Disabilities Education Act (IDEA) 2004, the Bureau of Indian Education (BIE) is required to publish their annual Part B Grant Award application for 60-days, of which 30 days must be allowed to accept public comment. The application for Federal Fiscal Year (FFY) 2021 includes the required assurances and certifications for the BIE to be eligible to receive the FFY 2021 Part B funds.

This application includes assurances and provisions which the state can and/or cannot make as mandated by Part B of IDEA in order to provide the appropriate services to Indian children with disabilities who are enrolled in Bureau-funded schools, including Tribal Contract and Grant schools. Also included are the certifications and other information pertinent to the application.

The BIE Part B Grant Award application is posted beginning April 2, 2021, and ending June 1, 2021. The public comment period starts April 2, 2021, and ends May 2, 2021.

Bureau of Indian Education Accountability Waiver 

On February 22, 2021, the U.S. Department of Education (ED) issued guidance inviting states and the Bureau of Indian Education (BIE) to request a waiver for the 2020-2021 school year of the accountability and school identification requirements in the Elementary and Secondary Education Act of 1965 (ESEA). If BIE requests and receives this waiver it would not be required to implement and report the results of its accountability system, including calculating progress toward long-term goals and measurements of interim progress or to annually meaningfully differentiate among its schools using data from the 2020-2021 school year. This flexibility would explicitly include waiving the requirement that the Academic Achievement indicator be adjusted to account for a participation rate below 95 percent. BIE would also not be required to identify schools for comprehensive support and improvement (CSI), targeted support and improvement (TSI), and additional targeted support and improvement (ATSI) based on data from 2020-2021 school year. BIE would be required to continue to support previously identified schools in the 2021-2022 school year, resume school identification in the fall of 2022, and ensure transparency to parents and the public.
